The Westbank First Nations (WFN), whose land spans 5,300 acres across 5 reserves, are the owners of the land. There are approximately 855 Westbank First Nation Members, the majority of which reside on reserve along with 9,000 non-Member residents. Westbank is a great community to live in, full of thriving businesses and economic opportunities.
Here’s how the Lease process typically works for reserve lands: 
  1. A developer enters into a long-term Lease with a Band Member – a “Head Lease”
  2. The many residential and commercial subdivisions on WFN have an underlying long-term Head Lease which grants the developer the rights to those lands for the term on the Lease.
  3. The developer then, as Lessee, develops the land either commercially or residentially, then “Subleases” the individual units (homes, apartments, townhomes) to buyers (Sublessees)
  4. Those buyers may then go to their bank or credit union to borrow money to finance their purchase by way of mortgage of Sublease.

The WFN has been self-governed since 2005 and it has a stable and secure government. Originally, the agreement was for long-term, 99-year prepaid leases but that is now being extended to a 125-year lease.

The leases are non-cancellable and you can’t get kicked out for failure to pay rent or rent reviews, either.

The WFN is the taxation authority, but they use the same assessment methodology as freehold land. The taxes are reasonably in line with the neighboring municipalities and homeowner grants are allowed in much the same way as freehold land.

One thing you’ll be happy to hear–you’re exempt from BC’s provincial carbon tax credit!

One of the most popular benefits of leasehold land is how much more affordable it is compared to freehold land. You’ll also save a lot of money on taxes with a leasehold as there’s no property transfer tax (at least not yet), no speculation tax, and no foreign buyer’s tax.
